Public Offer

1. General provisions

1.1. This Public Offer, hereinafter referred to as the “Offer”, is an official proposal of OOO “Sochinyay Mechty”, hereinafter referred to as the “Service Provider”, addressed to an indefinite number of persons, to enter into an agreement under the terms set out in this document.

1.2. The Offer applies to relations connected with the use of the website https://thedreamerscafe.ru/en/, table reservations, submission of requests, purchase of goods, gift certificates, participation in workshops, events and receipt of other services of The Dreamers Cafe.

1.3. By making a reservation, submitting a request, paying for a product, service, certificate or event, the User confirms that they have read the terms of the Offer and accept them in full.

1.4. If the User does not agree with the terms of this Offer, the User must refrain from placing an order, making a reservation, making a payment or submitting a request through the Website.

2. Service Provider

3. Subject of the Offer

3.1. The Service Provider undertakes to provide the User with services, goods, gift certificates, reservations, participation in events or other offers of The Dreamers Cafe, and the User undertakes to accept and pay for them where the offer is paid.

3.2. The specific terms of an offer, including its contents, description, price, date, time, procedure for receipt or use, are indicated on the Website, in the menu, in the service card, in the request form, in correspondence with the User or in other information materials of the Service Provider.

3.3. Information on the Website may be for reference purposes. The Service Provider may clarify availability, price, composition of the offer, reservation time and other conditions before confirming the request or receiving payment.

4. Acceptance of the Offer

4.1. Acceptance of the Offer means that the User performs one or more of the following actions:

• making a reservation through the Website, by phone, via messenger, social media or other communication channels;
• filling in and submitting a request form on the Website;
• paying for a product, service, certificate, event or other offer of the Service Provider;
• confirming an order or reservation in correspondence with the Service Provider;
• actually receiving a service, product or participating in an event.

4.2. From the moment of acceptance of the Offer, the agreement between the User and the Service Provider is considered concluded under the terms of this Offer and the relevant offer.

4.3. Acceptance of the Offer means the User’s full and unconditional agreement with all terms of this document without any exclusions or limitations.

5. Services, goods, certificates and events

5.1. The Service Provider may offer the following to Users:

5.3. Alcohol products, if presented in the cafe menu, are sold only in the manner and cases provided for by the laws of the Russian Federation. Remote sale of alcohol products through the Website is not carried out.

5.4. The Service Provider may change the assortment, menu, composition of offers, event schedule and prices before the order is confirmed or payment is made.

6. Price and payment procedure

6.1. The price of goods, services, certificates and events is indicated on the Website, in the menu, in the request form, in correspondence with the User or in another way used by the Service Provider to inform the User.

6.2. Payment may be made in cash, by bank card, by bank transfer, through payment services or by other methods available from the Service Provider at the time of placing the order.

6.3. The User’s payment obligation is considered fulfilled from the moment funds are received by the Service Provider or successful payment is confirmed by the payment service.

6.4. When payment is made through third-party payment services, the payment is processed by the relevant payment operator, bank or service under their own terms.

6.5. The Service Provider may set a prepayment or deposit for certain reservations, events, certificates or special offers. Prepayment terms are communicated to the User before payment is made.

7. Reservations and cafe visits

7.1. A table reservation may be made through the Website, by phone, via messengers, social media or other communication channels specified by the Service Provider.

7.2. A reservation is considered confirmed after the User receives confirmation from the Service Provider or after the User fulfills prepayment conditions, if prepayment is required.

7.3. The Service Provider may ask the User to provide their name, contact phone number, number of guests, date, time, seating preferences and other information necessary for the reservation.

7.4. The Service Provider may cancel a reservation if it is impossible to contact the User, if the User is late, if prepayment was required but not made, or in other cases where the reservation cannot be fulfilled for objective reasons.

7.5. The User must comply with the rules of visiting the cafe, treat staff and other guests respectfully, and refrain from actions that violate public order or interfere with the cafe’s operation.

8. Cancellation, rescheduling and refunds

8.1. The User may cancel a reservation, request or participation in an event by notifying the Service Provider using the contact details indicated on the Website.

8.2. The possibility of a refund, rescheduling, changing the order contents or replacing a service is determined taking into account the nature of the offer, expenses actually incurred by the Service Provider, cancellation terms and the requirements of the laws of the Russian Federation.

8.3. Separate cancellation and refund terms may apply to certain events, certificates, special offers or individual orders. The User is informed of such terms before payment is made.

8.4. If there are grounds for a refund, the refund is made using the same payment method by which payment was made, or by another method agreed by the parties, provided that this does not contradict the rules of the payment service or applicable law.

8.5. If a service has actually been provided, a product has been transferred, an event has taken place and the User has used the relevant offer, refunds are made only in cases provided for by law or by the specific terms of the offer.

9. Rights and obligations of the parties

9.1. The Service Provider undertakes to:

• provide the User with reliable information about goods, services and offers;
• process requests and reservations within a reasonable time;
• provide services of proper quality in accordance with the terms of the offer;
• comply with the laws of the Russian Federation;
• ensure confidentiality of the User’s personal data.

9.2. The User undertakes to:

• provide accurate contact details and information necessary to process the request;
• pay for goods, services, certificates and events in a timely manner where the offer is paid;
• comply with the cafe rules and the terms of the specific offer;
• not use the Website or the Service Provider’s communication channels for illegal actions, spam or abuse.

9.3. The Service Provider may refuse to provide a service or cancel a reservation if the User’s actions violate the Offer, cafe rules, the law, or create a risk to staff, guests, property or the reputation of the Service Provider.

10. Final provisions

10.1. The Service Provider may amend this Offer unilaterally. A new version becomes effective from the moment it is published on the Website, unless another effective date is specified in the new version.

10.2. The relations of the parties are governed by the laws of the Russian Federation.

10.3. The parties shall seek to resolve all disputes and disagreements through negotiations. If settlement is not possible, the dispute shall be resolved in accordance with the procedure established by the laws of the Russian Federation.
